Este ensaio celebra as cinco décadas da publicação do livro A ordem do discurso de Michel Foucault, realizando uma reflexão acerca de sua repercussão entre as ciências sociais e sobre seus usos, principalmente, no campo da linguagem na parte relacionada à análise do discurso de linha francesa. Portanto, trata-se de uma retrospectiva crítica cuja análise começa com a entrevista que Foucault concedeu algumas semanas antes de proferir esta aula aos brasileiros Sergio Paulo Rouanet e José Guilherme Merquior. Em seguida, o (...) presente trabalho faz uma breve história da entrada de Foucault ao Collège de France e, por fim, lida com a microfísica do discurso que se encontra nesta aula, sobretudo, da rarefação do sujeito, além dos seus usos nas ciências humanas e sociais mais o campo da linguagem em torno da pragmática e das análises de discurso. How can imperceptible knowledge such as professional routines in class immediacy be taught? How to express their main principles and their construction in formation? These routines create a sense of security among both students and teachers; it is a frame favouring successful classroom management. They come under the scope of integrated competencies, and this prompts their analysis in view of understanding a central link within initial professionalization. This paper will present the concept of professional routines as an educational practice in (...) regards to professional development, then the conceptual frame, the analytical method, some results followed by a discussion and conclusion. Comment enseigner un savoir imperceptible comme des routines professionnelles dans l’immédiateté de la classe? Comment dégager les principes organisateurs et leur construction en formation ? Pour une gestion de classe efficace, il est essentiel de recourir à des routines professionnelles. Elles soutiennent le sentiment de sécurité tant chez l’enseignant que chez les élèves. Elles relèvent de compétences incorporées, ce qui force à leur analyse pour une articulation phare dans une formation professionnalisante. Nous présenterons le concept des routines professionnelles comme un savoir-faire nécessaire au développement professionnel, le cadre conceptuel, la méthodologie, quelques résultats et la discussion suivie de la conclusion. Descartes développe, dans ses Principes de la Philosophie, les principes fondateurs de son système construit sur l’identification de la matière à l’espace. L’analyse de ses principes nous invite à repenser le rôle de la métaphysique dans la constitution de la science et permet aussi de comprendre comment les concepts de matière, substance, espace, étendue géométrique, mouvement, infini et vide sont devenus les questions centrales de la science du XVIIe siècle.

Cet article se base sur des résultats d’enquête récents montrant que, chez des adolescents marocains âgés de dix à dix-huit ans, les manifestations de pensée critique dialogique se si-tuent majoritairement dans une « perspective épistémologique » appelée « relativisme » par un modèle développemental élaboré dans les quinze dernières années avec la méthode de la théorie ancrée. Pour comprendre ces résultats de recherche, qui contrastent avec ceux obte-nus auprès d’adolescents québécois et français appartenant aux mêmes groupes d’âge, nous décrivons, dans (...) un premier temps, le modèle développemental dans lequel ils prennent sens. Nous illustrons ensuite les manifestations de « perspective épistémologique relativiste » chez les adolescents marocains à l’aide d’extraits de verbatim. Les élèves ont tendance à se décen-trer de leur vécu personnel, à se représenter le point de vue d’autrui en général et à co-construire des points de vue convergents avec les pairs. Dans un deuxième temps, prenant appui sur une approche de la représentation sociale en tant que « scène », et sur la littérature touchant aux rôles des aînés dans les sociétés africaines, nous éclairons ces résultats de re-cherche par l’analyse d’une représentation sociale fréquemment mobilisée par les jeunes Ma-rocains interviewés : celle de la hiérarchie des âges et du devoir d’écoute envers les plus âgés. L’analyse de cette « scène » met en lumière des attitudes sociales inculquées aux adolescents en contexte culturel marocain, susceptibles de favoriser le développement d’une « perspective épistémologique relativiste » en matière de pensée critique dialogique. Este artigo busca adentrar pelas questões relacionadas à biopolítica do corpo, sobretudo, daquelas ligadas à estatização do biológico e do racismo do Estado, que aparecem nos trabalhos de Michel Foucault e que aqui evocamos para analisar o corpo enquanto objeto discursivo analisável dessa biopolítica em duas produções francesas de horror, - Frontière(s) e em À l’interieur – que exibem imagens dos tumultos de Outubro de 2005, acontecimento marcado pelos protestos contra a política de perseguição aos sans-papiers que vitimou três jovens (...) de origem africana. É a partir daí que retomaremos a discussão do “quem somos nós”, em Foucault, para refletir sobre o sujeito, a menoridade e a liberdade na estatização do corpo, um lugar da memória nacional. (shrink)

Neste capítulo, vamos tratar do discurso-corpo demarcado pelas utopias em justaposição com as heterotopias em duas produções cinematográficas do horror francês contemporâneo. Dessa forma, o corpo que operamos é feito de discurso, ou seja, todo seu tecido, seus órgãos, seus sistemas, seus ossos são discursos sobrepostos pelo visível e pelo dizível, da mesma forma, como demonstrou Foucault na obra O Nascimento da Clínica em 1963.

Os corpos no cinema estão sob a ordem de um olhar soberano que nos diz para onde devemos olhar e como devemos fazer isso. É um olhar poderoso que tudo sabe e tudo pode. Um olhar que nos posiciona não como simples espectadores, mas como sujeitos. É a partir daí que buscamos compreender como se arquitetam o medo, ou seja, qual é a ordem do cinema de horror, tecido com a pena do medo? Nessa arquitetura, os corpos aparecem como lugares (...) para vigiar e punir em espaços utópicos e heterotópicos. Espaços de memórias. Espaços de poder vigiar e punir. Espaço onde se impõe uma posição de sujeito, um poder sobre o sujeito. Portanto, os corpos no cinema de horror são artefatos para uma arqueologia do medo, escrita pelo poder do horror sobre estes corpos. Daí nosso interesse por esses lugares. Para demonstrar essa arqueologia, utilizaremos dois filmes franceses, produzidos em 2007, Frontière(s) e À l’interieur como espaços de horror construídos para o medo pelas vias da utopia e heterotopias pensadas por Michel Foucault, filósofo do presente, do nosso presente para compreender como se arquitetam tal medo por meio de sua história arqueológica, prática de um espaço chamado Labedisco/UESB. A militância política de Jorge Amado no Partido Comunista é um capítulo à parte na história do comunismo no Brasil, que completou 100 anos no dia 25 de março. Ela também é algo marcante em sua obra, a ponto da crítica literária brasileira, de tradição uspiana, considerá-la uma forma de panfleto partidário da nossa esquerda. Nesta exposição, pretende-se realizar uma breve discussão acerca de suas lutas políticas, das quais se destacam as questões religiosa e racial, que levaram Jorge Amado a (...) criar um projeto de lei, no período que exerceu o mandato de deputado constituinte pelo PCB, em 1946, assegurando a liberdade religiosa no Brasil. Aqui, também se destaca a sua amizade com o povo de candomblé que lhe honrou com títulos, como o de Obá de Xangô e Ogã de Iansã; além da forma como a crítica o rotulava de regionalista e escritor panfletário. Contudo, esta é uma forma de homenagear tanto o mais famoso dos doze Obás de Xangô da Bahia, quanto o Partidão, nesse seu centenário. Em termos metodológicos, trata-se de uma leitura ensaística foucaultiana sobre esses fatos e acontecimentos que marcaram duplamente a vida de Jorge Amado e do Comunismo no Brasil, já que lançamos mão de uma parte da maquinaria teórica do militante comunista do PCF (Partido Comunista Francês), Michel Foucault, como vontade de verdade, comentário, discurso, autoria, obra, descontinuidade (na continuidade) e dispersão. Este estudo tem como objetivo principal discutir qual o lugar da memória nas pesquisas históricas empreendidas pelo filósofo francês Michel Foucault, o qual foi responsável pelo desenvolvimento de duas frentes metodológicas de trabalho: a arqueologia do saber e a genealogia do poder, conhecidas hoje como arqueogenealogia foucaultiana. Ao longo de mais de 30 anos dedicados a estas pesquisas, Michel Foucault ganhou projeção nacional e internacional pela sua inquietante forma de aliar a militância política com o trabalho acadêmico, demonstrando, com isso, (...) qual era o papel do intelectual frente aos desafios e demandas no mundo do pós-guerra. Recebeu a maior honraria no mundo da intelectualidade francesa ao ser eleito professor do célebre Collège de France, assumindo, por mais de uma década, a cátedra história dos sistemas de pensamentos. Em uma de suas últimas entrevistas, declarou que todos os seus gestos tinham como principal objetivo: criar a história como os seres humanos se tornam sujeitos em nossa cultura. Esta declaração deixa evidente qual o lugar que a história ocupa em sua obra, mas qual seria o lugar da memória nesses seus empreendimentos? Por que a história aparece em seu trabalho como lugar privilegiado enquanto a memória tem um lugar de coadjuvante? São estas as reflexões iniciais que buscamos realizar neste nosso trabalho. The principal objective of this study is to present and discuss the elements that emerge from Michel Foucault's archeological undertakings, which, in our view, configure the existence of a new rhetoric that deals with what the French philosopher called the rarefaction of the subject and rarefaction of discourse in his inaugural lecture at the Collège de France (Foucault, 1996). This new rhetoric would be in charge of reflecting and analyzing the phenomena that result from both the rarefaction of the (...) subject and the rarefaction of discourse, that is, such rhetoric invests in what is responsible for imposing on the speaking subject what to say and how to say it. Therefore, it turns to certain mechanisms of control of discourses that Foucault presented in The Discourse on Language, a work that completes five decades of its publication. This Foucauldian rhetoric also has as its main function to deal with the history of the present, that is, to reflect on what we do and think at this exact moment, which, in turn, would be in charge of contributing to the history of how we became subjects in a culture like ours, at this stage of high modernity and the Information Age. From this perspective, she would be interested in the processes of identification and subjectivation that result from the ways in which we become subjects. In short, it is a study that seeks to present elements that demonstrate the emergence of a new rhetoric that emerges from the work of Michel Foucault, who, according to Deleuze (1992), increasingly invested in a generalized pragmatics. Tout le film est toujours une microphysique du pouvoir, en potence, d’être étudier. Aujourd’hui l'augmentation des productions d'horreur et son public ont fait le film d'horreur une «contreculture» dominante, mais toujours sous l'effet négatif du pouvoir et du savoir qui disqualifient les discours, matérialisée dans ces films, ce qui les rend illégitime et exiler en soi espace filmique, transformée en un lieu adapté pour interdite et marquée par certaines pratiques discursives avec certains dispositifs d'exclusion. Paradoxalement, les types marginaux qui apparaissent (...) dans l'ordre de ces productions occupent les positions de sujets à exercer le pouvoir dans l'horreur et dans le même temps le renforcement de leur marginalité et de son objectivation. Ces aspects et les spécificités qui caractérisent les productions d'une part, nous ont amenés à identifier les pratiques de l'objectivation qui transforment corps dans les sujets dans l'horreur; d'autre part, de démontrer que ces films constituent une nouvelle technologie de contrôle social des corps, mais l'objectif principal de cette étude est d'analyser les relations de pouvoir à travers l'antagonisme des stratégies dans ce discours, qui est, pour savoir ce que cela signifie d'avoir un corps libre, nous examinons ce qui se passe sur le corps subjugué dans les films d'horreur, prenant l'archeogenealogie de Foucault comme base théorique. Cette questionhypothèse aurait un autre groupe: d'où pourrait faire une telle histoire? Nous supposons que dans les moments de crise, les films d'horreur ont beaucoup à prouver, donc nous avons opté pour un très similaire à celui qui Foucault a été invité par les experts de la revue Cahiers du cinéma pour discuter des conditions pour les productions cinématographiques comme Le Chagrin et la Pitié (1969), Portier de nuit (1974) et Lacombe Lucien (1974), quand on a regardé le déclin du gaullisme et l’ascention de Valéry Giscard d'Estaing , le vainqueur de la présidentielle de 1974, avec le soutien de l'ancien droit Tardieu et petainistes, anciens alliés de l'occupation du Führer Hitler de la France, entre 1940 à 1943. Maintenant, les conditions de production sont ceux qui marquent la fin des gouvernements socialistes de Mitterrand et Chirac, et le retour au pouvoir de la droite, à l'ascension politique de Nicolas Sarkozy. Au milieu de la crise économique de l'Union Européenne, flotte dans l'air la peur terrifiante de risque que l'arrivée de l'extrême droite au pouvoir. La présence croissante d'immigrants est aussi dans l'ordre d'une nouvelle crise de l'identité française. Ce sont les conditions de production de À l'intérieur, Frontière (s),Martyrs, Ils, La Meute, Captifs et Derrière les murs et, des films qui font partie de notre corpus. À la methodologie, nous développons les trois concepts opérationnels: le dispositif filmique de la mémoire, de la vérité et de l'objectivité pour traiter la mémoire populaire, recodé dans ces films et soi-disant perçu par nous comme l'un des principaux modes de contrôle des corps d’horreur; la notion d’intericonicité est encore utilisée pour indiquer des images qui renvoient à d'autres, mais tout en réalisant que chaque image a dans sa juxtaposition afin de utopies des hétérotopies. Donc, nous avons décidé de donner une nouvelle forme à cette notion, y compris l'utopique juxtaposés à des espaces hétérotopiques, sous l'influence de la discussion faite par Foucault dans le Corps utopique et Les hétérotopies. This paper tracks the development of Merleau-Ponty's inquiries into language through the themes of institution, symbolism, and nature in his Collège de France lectures of 1953-1960. It seeks to show the continuity of Merleau-Ponty's inquiries over this period. The Problem of Speech course (1953-1954) constitutes his last extended treatment of speech, language, and expression, and it leaves many questions unanswered. Nonetheless, a careful study of the course reveals that the inquiries that follow into institution and symbolism, and later into (...) nature, do not mark a sharp rupture with his earlier thought. Rather, the later investigations are required by those into language and expression to clarify the underlying functions that support them. Ultimately, the themes of language and nature will be deeply interwoven in Merleau-Ponty's late thought, with institution and symbolism serving as important mediating concepts. (shrink)

In his initial lecture course at the Collège de France, Merleau-Ponty attempted to develop a new analysis of rational thought in order to clarify its link with corporeal-perceptive life. The formulation of thought in language as the most elaborate human activity of expression explicitly takes over what we already observe in perception as the implicit and mutual reference between the perceiving subject and that which is perceived.The article reconstructs Merleau-Ponty’s argumentation, based on his preparatory notes for the lectures, and (...) provides an interpretation of the key concepts of “expression” and “body schema”. Le climat politique actuel en France abonde de débats à propos de l’identité nationale et du voile; en fait, le voile est devenu un symbole séparant l’idée d’une nation française et d’une nation islamique. Cependant, peu d’attention est portée sur la façon dont la perception de la différence de la femme est essentielle à la formation du citoyen français. Au lieu de se demander simplement “que veut dire être Français?” une seconde interrogation devrait suivre sur la façon dont se (...) construit la femme voilée dans la société française. En faisant appel à la philosophie de Hegel, les réflexions philosophiques employées pour ce projet cherchent à poser de nouvelles questions pouvant éclairer le débat sur l’identité nationale: la femme voilée est-elle l’Antigone des temps modernes? Entrevista realizada a Audrey Louyer sobre la Literatura peruana fantástica.

À la toute fin de l’article « Épicuréisme ou Épicurisme » de l’Encyclopédie, après une adaptation très particulière de l’information qu’il a trouvée dans l’Historia Critica Philosophiae de Brucker, Diderot écrit une brève histoire de l’épicurisme moderne se concluant par cette phrase significative : « en quelque lieu & en quelque tems que ce soit, la secte épicurienne n’a jamais eu plus d’éclat qu’en France, & sur-tout pendant le siecle dernier. » Ma contribution prend prétexte cette affirmation pour essayer (...) de penser ce que signifie, pour Diderot, constituer une secte épicurienne aux XVIIe et XVIIIe siècles. Il devient alors possible de clarifier ce que sont les modalités du rapport à l’histoire de la philosophie impliquées dans cette affirmation, et le sens que Diderot prête à la filiation et à l’héritages philosophiques. Penser l’épicurisme moderne devient une manière de contester le récit simplificateur d’une modernité qui ne se définirait que par la rupture avec le passé. (shrink)

In this work we present the function and we determine the nature of conventions and hypotheses for the scientific foundations according with the conventionalist doctrine that arose in France during the turning of the XIX century to the XX. The doctrine was composed by Henri Poincaré, Pierre Duhem and Édouard Le Roy. Moreover, we analyze the relation that conventions and hypotheses can establish with metaphysical thesis through criteria used by scientists in order to determine the preference for certain theories. (...) Thereunto, we promote an immanent interpretation of published works between 1891 and 1905. As result, we reveal that the authors, though being classified as belonging to the same doctrine, don't have only common grounds, but also divergences. Poincaré and Le Roy agree that geometrical conventions are chosen in accordance with convenience criteria. However, they disagree about the value convenience aggregate to scientific knowledge. In regards to natural phenomena, the three authors agree that reality can't be described univocally by the same set of conventions and hypotheses. Yet, Poincaré and Duhem both believe that there are experimental, rational and axiological criteria that justify scientist's satisfaction with certain theories and we indicate how those criteria are related with metaphysics. We conclude that conventionalists, even if warily and implicitly, searched to approach metaphysics in order to justify scientific activity. (shrink)

Se trata de un artículo que busca una relectura de los textos y problemas en la obra del filósofo francés Louis Althusser. Hay dos líneas argumentativa que sigue la relectura: 1) su materialismo aleatorio, y 2) su teoría del lenguaje.

If you retain your belief upon learning that a large number and percentage of your recognized epistemic superiors disagree with you, then what happens to the epistemic status of your belief? I investigate that theoretical question as well has the applied case of philosophical disagreement—especially disagreement regarding purely philosophical error theories, theories that do not have much empirical support and that reject large swaths of our most commonsensical beliefs. I argue that even if all those error theories are false, either (...) (a) the average philosopher’s true commonsensical beliefs are epistemically impoverished, or (b) a good portion of philosophy is bunk and philosophers should give up most of their error theories despite the fact that their supporting arguments are generally as good as or even better than other philosophical arguments. L’objectif de cet article est de comprendre l’importance de la métaphysique analytique pour le travail philosophique et pour l’enseignement dans le contexte français. Pour cela, je commencerai par exposer ce qu’il faut entendre par métaphysique analytique, puis j’examinerai plusieurs conditions de possibilité de la métaphysique analytique en France : la relecture de l’histoire de la métaphysique, des découvertes en logique, une réflexion sur l’objectif et un examen rapide des conditions matérielles et sociales d’enseignement et de recherche.

One of Fabio Rossi’s most important works analyses the themes of evil and suffering in 20th-century French philosophy. Among others, Rossi presents Louis Lavelle’s contribution on such themes and his reading of the mutual influences between philosophical reflection, emotional experience and religious transcendence. The article aims to make use of some of the conceptual tools made available by Rossi and Lavelle in order to understand François Mauriac’s treatment of evil and suffering in some of his novels, namely Le Mystère Frontenac, (...) Noeud de vipères and Le Mal. The role of family bonds, social rules, the body and its weaknesses, and nature are among the themes around which Mauriac centers his reflection about suffering and its inevitable presence in human life. Those of us who take skepticism seriously typically have two relevant beliefs: (a) it’s plausible (even if false) that in order to know that I have hands I have to be able to epistemically neutralize, to some significant degree, some skeptical hypotheses, such as the brain-in-a-vat (BIV) one; and (b) it’s also plausible (even if false) that I can’t so neutralize those hypotheses. There is no reason for us to also think (c) that the BIV hypothesis, for instance, is plausible (...) or probably true. In order to take skepticism seriously it’s sufficient to hold (a) and (b); one need not hold (c). Indeed, philosophers who accept (a) and (b) never endorse (c). Show me a philosopher who suspects that he is a brain in a vat and I’ll show you someone who is deranged! That’s one thing that bothers undergraduates in philosophy. They object: why on earth do some philosophers take the BIV hypothesis to pose any threat at all to our beliefs given that those very same philosophers think that there’s no real chance that the BIV hypothesis is true? Sure, the BIV hypothesis is formally inconsistent with my belief that I have hands, so if the former is true then my belief is false. But so what? Why should that bare inconsistency matter so much? Is this strange attitude amongst philosophers the result of some logic fetish infecting the philosophical community? It is sometimes said that the skeptical hypotheses are not only inconsistent with our beliefs but are explanatory of our experiences, which is supposed to make them more of a threat. But students aren’t fooled: although the skeptical hypotheses may attempt to explain why our experience is as it is, it’s the kind of attempt appropriate for science fiction movies that are all special effects and virtually no plot. No one with any sense of reality will take the evil demon hypothesis to be even tenuously explanatory. (shrink)

A common kind of explanation in cognitive neuroscience might be called functiontheoretic: with some target cognitive capacity in view, the theorist hypothesizes that the system computes a well-defined function (in the mathematical sense) and explains how computing this function constitutes (in the system’s normal environment) the exercise of the cognitive capacity. Recently, proponents of the so-called ‘new mechanist’ approach in philosophy of science have argued that a model of a cognitive capacity is explanatory only to the extent that it reveals (...) the causal structure of the mechanism underlying the capacity. If they are right, then a cognitive model that resists a transparent mapping to known neural mechanisms fails to be explanatory. I argue that a functiontheoretic characterization of a cognitive capacity can be genuinely explanatory even absent an account of how the capacity is realized in neural hardware. (shrink)

Théodule Ribot est l’un des premiers à penser les rapports entre mémoire et émotions. Au sein de ce qu’il appelle la « mémoire affective », il décèle une mémoire spécifique des émotions. Il s’ensuit un débat sur l’existence, la définition et le contenu de cette mémoire. Après les propositions initiales de Ribot, on observe l’émergence progressive d’un consensus : même s’il est possible de distinguer la mémoire affective de la mémoire intellectuelle, tout souvenir présente à des degrés variables des éléments (...) intellectuels et des éléments affectifs. Si, dans le cadre académique, ces débats sont tombés dans l’oubli, on peut établir une continuité conceptuelle avec la recherche scientifique actuelle, qui gagnerait à relire cette littérature centenaire. ABSTRACT: In its historical deployment, socialist thought has attracted the attention of numerous experts and thinkers. The results reached from the above mentioned efforts, are quite irregular in fact. These studies are very often linked the marxist tradition, that shifted its identity to label previous social reformers as "utopian socialists". Specifically, our academic Spanish tradition has traditionally been dependant -historically and intellectually- on other Continental currents of thought. We state, that the preeminence and fundamental influence on our Spanish culture in (...) the Iberian Peninsula, has traditionally had its origin here, between modernity and industrialism, in France. Consistently, contributions concerning authors like Saint-Simon, Fourier or Cabet do exist. However, it is necessary to say that there is a bibliographical and very significant emptiness around one of the most relevant figures of European history in the 19th Century. Such emptiness has to do with the absence of publications concerning Robert Owen and his meaning in Spanish. A common kind of explanation in cognitive neuroscience might be called functiontheoretic: with some target cognitive capacity in view, the theorist hypothesizes that the system computes a well-defined function (in the mathematical sense) and explains how computing this function constitutes (in the system’s normal environment) the exercise of the cognitive capacity. Recently, proponents of the so-called ‘new mechanist’ approach in philosophy of science have argued that a model of a cognitive capacity is explanatory only to the extent that it reveals (...) the causal structure of the mechanism underlying the capacity. If they are right, then a cognitive model that resists a transparent mapping to known neural mechanisms fails to be explanatory. I argue that a functiontheoretic characterization of a cognitive capacity can be genuinely explanatory even absent an account of how the capacity is realized in neural hardware. (shrink)

En muchos sentidos, La sociedad del espectáculo parece más haber sido escrita por estos días que hace más de 50 años. Desde la denuncia de la conversión de la política en un show business, pasando por la espectacularización vacía del arte y de la cultura en general, la prensa del escándalo y el sensacionalismo como gancho para subir el rating, hasta los reality shows que, desprovistos ya de todo pudor, asumen descarnadamente su función de hacer espectáculo por espectáculo, sin importar qué se meta adentro, todo ello, parece haber sido retratado ya en el libro de Debord como una consecuencia inevitable de esta nueva etapa de la enajenación humana, abarcadora de toda la espiritualidad y en la que terminan por perderse las fronteras entre show y vida. Neste prefácio a Siris, publicada em francês com o título Recherches sur les vertus de l’eau de goudron, où l’on a joint des réflexions philosophiques sur divers autres sujets, além de oferecer um bom resumo da obra, Boullier explica a filosofia imaterialista de Berkeley e a apresenta favoravelmente como um (...) antídoto interessante para as concepções materialistas. Histoire et utilisation du robot Bien que la robotique soit un marché économique relativement jeune et en pleine croissance, la genèse des robots remonte à l’Antiquité. Le premier robot à être déployé sur des lignes d’assemblage est Unimate, utilisé dès 1961 par General Motors. La robotique, en se di usant dans tous les pans de notre économie, va impacter les business modèles de nombreuses industries comme l’automobile et l’aéronautique mais aussi la construction ou l’agriculture. Aujourd’hui les robots industriels et de (...) service servent à de multiples tâches allant de la logistique à l’usinage en passant par la fonderie. La robotique constitue aussi et surtout un enjeu sociétal contribuant à relever les dé s de la mobilité, de la santé, de l’autonomie, du vieillissement et de l’éducation. Absence de dé nition et de régime juridique spéci que au robot En France, la notion de robot ne fait pas l’objet d’une dé nition juridique qui lui est propre. Les dé nitions relatives à l’environnement robotique peuvent tout de même se retrouver dans la norme ISO 8373:2012. Bien que les robots intéressent les juristes à plusieurs titres, le législateur n’a, à ce jour, pas adopté de régime juridique spéci quement applicable aux robots. Il convient donc de rechercher dans le droit positif le corpus de textes applicables aux robots. Ce corpus pourra alors recevoir l’appellation de « droit de la robotique ». Garanties Le vendeur d’un robot industriel et de service doit se conformer aux garanties légales que sont la garantie des vices cachés et la garantie d’éviction. Il doit également respecter les éventuelles garanties qui ont pu être convenues contractuellement Clauses contractuelles Le fournisseur d’un robot industriel et de service doit être particulièrement attentif aux clauses contractuelles rela- tives à la garantie, à la propriété intellectuelle, à la con dentialité, à la responsabilité et à la conformité aux directives techniques. Les spéci cités liées au robot, telles que les éléments relatifs à l’intelligence arti cielle, pourront être intégrées dans des annexes spéci ques. Intelligence arti cielle L’algorithme d’intelligence arti cielle dont est équipé un robot industriel et de service peut, dans certaines condi- tions, béné cier d’une protection grâce au droit d’auteur, à la protection du savoir-faire et au brevet. Aucun régime spécial n’existe à ce jour protégeant les œuvres conçues par le robot intelligent. Mobilité Les véhicules et drones autonomes utilisés au sein même de l’usine sont considérés comme des machines. Etant don- né les risques existants, il convient de xer de règles internes d’utilisation. Les véhicules autonomes ne peuvent à ce jour quitter l’espace privé. En revanche, les drones peuvent circuler dans l’espace aérien en respectant strictement le cadre réglementaire. Douanes Le taux de perception des droits de douanes d’un robot industriel et de service est conditionné par la connaissance de l’origine, préférentielle ou non préférentielle, du robot qui est déterminée par la position tarifaire de ce dernier. Le robot industriel et de service entre dans le chapitre 84, qui concerne notamment les machines, de la nomenclature du système harmonisé établi par l’Organisation mondiale de douanes. Sécurité En application de la « directive machines », le robot peut recevoir la quali cation de machine ou de quasi-machine. En vertu de cette directive, mais également au titre du Code du travail, de nombreuses obligations en matière de santé et de sécurité doivent être respectées pour la commercialisation et l’utilisation des robots. Conformité Le Code du travail, en transposant la « directive machines », a prévu de nombreuses obligations et procédures, appli- cables aux robots industriels et de service, permettant ainsi de s’assurer que ces derniers respectent les exigences de conformité nécessaires en matière de santé et de sécurité. Maintenance Dans le cadre de la maintenance, le fournisseur d’un robot industriel et de service est soumis à plusieurs obligations législatives aux titres de la disponibilité des pièces détachées et de la location. Les dispositions contractuelles de- vront prendre en considération les spéci cités propres au robot et ne pas ignorer la maintenance prédictive. Quali cation juridique Dans le cadre de la conception, de la fabrication et de l’utilisation du robot, il convient de porter une attention par- ticulière à quatre textes spéciaux qui peuvent être applicables aux robots industriels et de service : le règlement 428/2009 sur les biens à double usage, la directive 2014/35/UE applicable au matériel électrique basse tension, la directive 2014/53/UE applicable aux équipements radioélectriques et la directive 2014/30/UE sur la compatibilité électromagnétique. Responsabilité Bien que les régimes de responsabilité, civile et pénale, ne sont pas adaptés aux robots autonomes, la responsabilité civile de droit commun, la responsabilité du fait des choses, la responsabilité du fait des produits défectueux et la responsabilité des commettants du fait de leurs préposés peuvent s’appliquer en cas de fait dommageable causé par le robot tout comme la responsabilité pénale en cas d’infraction commise dans le cadre de l’utilisation du robot. Assurance La police d’assurance relative aux robots doit permettre de protéger le robot contre les risques auxquels ils sont confrontés mais également d’assurer la responsabilité pour les dommages qu’ils pourraient causer, on peut alors parler de « dommages robotiques ». Données et bases de données Les bases de données contenues dans un robot industriel et de service doivent respecter les droits dont dispose l’auteur sur la structure de la base de données et/ou les droits du producteur des bases de données dans lesquelles gurent les données utilisées. La réglementation Informatique et libertés est également applicable au robot lorsque celui-ci collecte et/ou traite des données personnelles. Droit de la robotique dans le monde Aucun Etat ne s’est à ce jour doté d’un régime juridique détaillé et spéci que à la robotique. Des dispositions juri- diques relatives aux robots peuvent tout de même se retrouver de façon éparse dans certains droits étrangers concer- nant notamment les drones et les véhicules terrestres autonomes. In the philosophy of perception, representationalism is the view that all phenomenological differences among mental states are representational differences, in other words, differences in content. In this paper I defend an alternative view which I call external sortalism, inspired by traditional adverbialism, and according to which experiences are not essentially representational. The central idea is that the external world serves as a model for sorting, conceptualizing, and reasoning surrogatively about perceptual experience. On external sortalism, contents are construed as a kind (...) of gloss on experiences themselves. We can retain what is attractive about representationalism, namely, that perceptual experiences can be evaluated for accuracy, without problematic commitment to the idea that they bear a substantive, representational relation to external objects and properties and that this relation determines the phenomenal character of experience. En el marco del V Congreso Internacional «La actualidad de Michel Foucault» celebrado en la Universidad Complutense de Madrid entre el 6 y el 8 de marzo de 2018, sostuvimos una interesante conversación con Daniel Lorenzini, investigador del pensamiento ético y político de Michel Foucault y editor de varios de sus cursos y conferencias publicadas en los últimos años en Francia. Discutimos sobre el estado actual de los archivos de Foucault adquiridos por la Biblioteca Nacional de Francia (BnF), algunos de (...) los diversos proyectos editoriales que se derivan del trabajo de archivo y análisis de los manuscritos del filósofo, la reciente e inesperada publicación de Les aveux de la chair y su relación con el proyecto de la Historia de la sexualidad tal como fue planteado en 1976, la relación de Foucault con Nietzsche respecto a sus lecturas de la subjetivación y el vínculo, no siempre evidente, entre ética y política a la luz de sus investigaciones sobre el filósofo francés. In this paper I present an interpretation of Immanuel Kant’s transcendental deduction of the categories (a dangerous interpretation it turns out), based primarily on the “two-step” argument of the B deduction of the Critique of Pure Reason. I undertake to show that Kant’s distinction between the “pure forms of intuition” and “pure formal intuition” is successful in its attempt to prove that all sensible intuitions presuppose the a priori categories, in a way which is compatible, I claim, with Kant’s statements (...) (in the Aesthetic and elsewhere) that sensible intuition is prior to all concepts; and therefore that the Transcendental Aesthetic presupposes the Transcendental Analytic. Thus my Interpretation is a "conceptualist" reading of the deduction, in holding that perception, as receptivity, presupposes an underlying spontaneity of the pure understanding and categories. The categories are held to be not just compatible with all possible sensible intuitions, but through their "transcendental content" constitutive of the relation of sensible intuitions to objects - and this explains how our thought can represent objects a priori. It is one of the claims of my interpretation that the logical forms of judgment of general logic derive from the pure categories of transcendental logic, rather than vice-versa. I.e. that the logical forms through which we make empirical judgments by combining analytical concepts in inner sense in time, are originally grounded in an atemporal categorial synthesis in pure intuition (i.e. in the form of time but not the dimension of time), referring an outer intuition in general to the transcendental object of intuition (as “something in general” outside sensibility or receptivity), thereby providing the synthetic unity of the manifold which “..all analysis presupposes.” My conceptualist reading of the deduction, I claim, avoids the problems associated with other conceptualist readings, for example inconsistency with the text (“Intuitions are prior to all concepts.” etc.) and blurring of the distinction between receptivity and spontaneity. In my paper I prove that the categories can correctly be held to provide the a priori unity of intuitions, notwithstanding the fact that the latter are “prior to all concepts,” because this unity is not provided by the categories as fully-fledged concepts in the empirical subject, but as the transcendental logical form of these concepts, as a unity in the pure understanding - and the categories therefore require their empirical content or application for their objective reality as concepts. I.e. the categories, as logical functions of judgment for transcendental apperception, in the pure forms of intuition, are prior to all "concepts", correctly speaking, as well as prior to all intuitions, and provide the necessary unity of both. Likewise, at the empirical level my version of conceptualism cannot be accused of blurring the distinction between receptivity and spontaneity, or sensibility and understanding, because although the transcendental content of the categories, as a logical function of judgment in the pure forms of intuition, in transcendental apperception, is in necessary relation to sensibility (in combining the manifold in the pure or formal representation of the transcendental object) their empirical content is not. - At the empirical level the divide between spontaneity (as judgment in the empirical subject) and receptivity (as the effect of transcendental synthesis and the transcendental object on outer and inner sense) remains intact. Conceptualist readings of the deduction also have to avoid infringing Kant’s requirement that the sensible manifold originally be given prior to and independently of all acts of the understanding, or otherwise to qualify the requirement in some way - e.g. by taking a Hegelian direction, such as that taken by John McDowell.1 On my reading of the deduction the sensible manifold given indeterminately in the pure forms of space and time must be given prior to the categorial synthesis of the manifold in the pure representation of the transcendental object, i.e. in the pure 'concept' of an object in general affecting sensibility. Therefore Kant’s requirement for an undetermined manifold given prior to, and independently of, all acts of the understanding (“..the manifold to be intuited must be given prior to the synthesis of understanding, and independently of it. In a later section of the paper, however, I will argue that the transcendental object (of intuition) does have pure theoretical reason as one of its two interacting immanent aspects, but is distinct from pure theoretical reason in the other of its (the transcendental object of intuition's) two interacting immanent aspects, i.e. pure will, which adds a Schopenhauerian element to my interpretation (which will be argued for in a way which supports Kantian optimism over Schopenhauerian pessimism however, in regard to the freedom of the will). Another perceived inconsistency in the deduction, which my interpretation can explain, is Kant’s description (in the B deduction) of the principle of the necessary synthetic unity of apperception as analytic, while in the A deduction it is described as synthetic. I explain this as a difference in the reference of terms such as “my representations” in the two versions - a transcendental reference in the B version but an empirical and transcendental reference in the A version of the principle. I also show that the first part of the two-step B deduction can correctly be characterised by Kant as analytic and the second, concluding part, synthetic (a point of dispute amongst Kant scholars) because transcendental logic (which refers to both the analytic and synthetic aspects of the principle of apperception) “does not abstract from the pure content of knowledge.” While being a “double aspect” rather than “two world” view of transcendental Idealism (because objects of intuition are comprised of both the empirical and transcendental object, i.e. transcendental referent, of intuition, my view differs significantly from the “double aspect” interpretation of Henry Allison (which distinguishes empirical reality from the “God’s eye” view). The view of transcendental idealism resulting from my reading of the deduction, I claim, allows a full empirical realism, because empirical intuitions, as objects of cognition, are the appearance of both the transcendental subject and the transcendental object (i.e. transcendental referent ) of transcendental synthesis (both as “something in general” outside sensibility or receptivity, or rather outside sensibility as receptivity). I conclude that Kant succeeds (although only with the addition of what I have called my 'Schopenhauerian element') in his attempt to prove that we have a transcendental unity of apperception which both constitutes, and is constituted by, the relation of sensible representations to objects, and that since transcendental apperception is the a priori underlying ground of empirical apperception, the categories (as the logical functions of judgment by which transcendental apperception relates sensible representations to objects) are the a priori underlying ground of all experience, and are therefore valid synthetically a priori for all objects of experience. 1 E.g. in “On Pippin’s Postscript.” European Journal of Philosophy 15:3 pp. 395-410. On Oct. 24, 2019, French philosopher Sylviane Agacinski was scheduled to speak at the Université de Bordeaux-Montaigne on « l’être humain à l’époque de sa reproductibilité technique » [the human being in the era of its technological reproducibility]. Amidst “violent threats” and their purported inability to assure the safety of Agacinski, the organizers cancelled the event. Agacinski and other French intellectuals lament what they perceive to be part of a “drifting liberticide”, a form of censorship that forbids the exchange of (...) ideas and forecloses open space for debate. The story goes that Agacinski, notable for her staunch opposition to surrogacy and extending assisted reproductive technologies (ARTs) to non- heterosexual couples, as well as her anthropological claim that the fabric of our social order relies on the heteronormative structure of sexual difference, has been silenced. In a communiqué to the university, student organizations such as Riposte Trans and Mauvais Genre-s pleaded “no platform”, indicating that Agacinski’s reactionary homophobic and transphobic positions run contrary to the university’s mission of safeguarding against discrimination. Afin d’examiner la forme et la fonction « cours » dans le corpus de Derrida, je propose une lecture du séminaire inédit « GREPH. Le concept de l’idéologie chez les idéologues français ». Ce séminaire fut mené dans le cadre des engagements politico-institutionnels du GREPH. Il constitue donc un point d’entrée privilégié pour saisir le rapport complexe que Derrida entretient avec l’enseignement, et plus généralement avec l’institution philosophique. Au cours de ce séminaire, Derrida s’intéresse au « corps enseignant » en (...) tant qu’il fonctionne comme « machine reproductrice » au sein de l’organisation économique générale de la société. Courant deux lièvres à la fois, Derrida mêle une réflexion généalogique sur l’histoire de l’enseignement philosophique en France et en Europe à une analyse théorique de concepts marxistes et sociologiques tels que « capital », « reproduction », ou « appareil idéologique ». À travers des lectures déconstructrices et transformatrices de Marx et d’Althusser, Derrida s’efforce de penser une autre économie — une économie du texte débordant la logique reproductrice qu’il identifie aussi bien chez les économistes classiques que chez leurs critiques marxistes.
